1. Agreement to Terms

By accessing or using the services provided by ForgeAFlow, a product of InterRail LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

ForgeAFlow provides digital marketing and technology services including but not limited to:

  • Website design and development
  • Search engine optimization (SEO)
  • Online reputation management
  • Lead generation and CRM solutions
  • AI-powered business automation
  • Digital advertising management
  • Brand identity and design
  • Business intelligence and analytics

3. Client Obligations

As a client, you agree to:

  • Provide accurate and complete information required for service delivery
  • Respond to communications in a timely manner
  • Make timely payments as agreed upon in your service agreement
  • Comply with all applicable laws and regulations
  • Not use our services for any unlawful purpose

4. Payments and Billing

  • All payments are processed securely through Stripe.
  • One-time project fees are due according to the payment schedule in your proposal or contract.
  • Recurring subscription fees are billed monthly and may be canceled at any time.
  • Refund policies are outlined in your individual service agreement.
  • Late payments may result in service suspension after a 15-day grace period.

5. Intellectual Property

  • Client Content: You retain ownership of all content you provide to us (text, images, logos, etc.).
  • Deliverables: Upon full payment, you receive ownership of custom deliverables created specifically for your project (websites, designs, copy).
  • Our Tools: ForgeAFlow retains ownership of proprietary tools, templates, frameworks, and methodologies used in service delivery.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of the engagement. This obligation survives termination of services.

7. Limitation of Liability

To the maximum extent permitted by law, ForgeAFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use of our services.

Our total liability for any claim arising from these terms shall not exceed the total amount paid by you for services in the twelve (12) months preceding the claim.

8. No Guarantee of Results

While we use best practices and data-driven strategies, we cannot guarantee specific results such as search engine rankings, lead volumes, or revenue increases. Digital marketing outcomes depend on many factors beyond our control, including market conditions, competition, and client participation.

9. Termination

  • Either party may terminate services with 30 days written notice.
  • We reserve the right to terminate services immediately if you violate these terms.
  • Upon termination, you are responsible for payment of all services rendered up to the termination date.
  • We will provide reasonable assistance in transitioning your assets upon termination.

10. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in DuPage County, Illinois, in accordance with the rules of the American Arbitration Association.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.

12. Modifications

We reserve the right to modify these terms at any time. We will provide notice of material changes by email or through our website. Continued use of our services after changes constitutes acceptance of the modified terms.
